Preserving Spanish Nationality (Article 24(1) Spanish Civil Code)
For those habitually resident in the UK and outside of Spain, who voluntarily acquire another nationality, or exclusively use a foreign nationality, which was gained before or exclusively use a foreign nationality, which was gained before “emancipación”, Spanish nationality will be lost 3 years after the date the foreign nationality was acquired or 3 years from the date of “emancipación”.
Nevertheless, interested parties may avoid losing Spanish nationality, if they declare their wish to preserve their Spanish nationality within the 3 years mentioned above, to the Spanish Embassy (if outside Spain) or local Spanish Civil Registry.
To preserve your Spanish nationality, the Spanish Consulate requires the following documents:
- 1. Form duly completed and signed by the applicant;
- 2. Photocopy of current Spanish and foreign passports of the applicant certified as a true copy;
- 3. Spanish birth certificate of the applicant issued within the last 6 months from the date of the submission of the document;
- 4. Translated, notarised and apostilled copy of the certificate of naturalisation.
